元ルノー・日産CEOのカルロス・ゴーン容疑者が10億円の保釈金を払って保釈された後に別件で再逮捕されました。これって10億円パァってこと・・・？

カルロス・ゴーン10億円保釈後に再逮捕、保釈金の行方は・・・？
なかなか驚きましたね・・・。10億円保釈金払った後に再逮捕とは・・・。
東京地検特捜部は4日、日産自動車前会長のカルロス・ゴーン容疑者（65）を特別背任の疑いで再逮捕した。金融商品取引法違反などの罪で逮捕され、先月6日に保釈されていたゴーン容疑者の逮捕は4回目となる。一度保釈された被告を再び逮捕するのは異例。
10億円の保釈金を払って通信機器を使わないなど色々と条件付きで保釈されていたカルロス・ゴーン容疑者。
今月に入って突如Twitterアカウントを開設し（そして公式バッジを付けて）、ツイートをしたのがニュースになりました。

・・・・と思ったらいきなりの再逮捕。10億円払って保釈されたのに1ヶ月経たずにまた拘置所に・・・？
これって記者会見をさせない、という検察の意思があったりしたんでしょうか・・・。

しかし、カルロスゴーン今65歳でしょ？まだ逮捕されちゃったから初公判は半年後とかなのかな。判決出るの来年末くらいかなー。それから最高裁までやるだろうからあと5,6年はかかるとしてその時72,3歳。有罪判決でたら実刑で5年は食らうから出るのが80歳近くなるね。悲惨だな。。

そして10億円の行方は・・・？ということで調べてみました。
保釈後の再逮捕は保釈金は保全される
さすがの日刊スポーツはこのポイントにちゃんと突っ込んでいます。
3月6日に保釈された日産自動車の前会長カルロス・ゴーン容疑者（65）が4日、再逮捕されたことを受け、容疑者が納付した保釈保証金10億円に現時点で影響がないことが分かった。
タイトルに「10億円は影響なし」、本文にも「現時点で保釈保証金は納付された状態のままだという。」とありますが、だからどうなの？という所はよく分からなかったです。
こういった保釈後の再逮捕はどうなるのか、ということで調べてみると・・。
保釈に強い弁護士さん、っていらっしゃるんですね。まぁ今回のカルロス・ゴーン容疑者の保釈も弁護士団が何度もトライしての結果だった、ということのようですが。
ただ流石に専門家、すごく分かりやすい説明がありました。
Ａ事件で保釈された後、Ｂ事件で逮捕された場合、その後はＢ事件での逮捕・勾留による身柄拘束が続きます。その意味で、Ａ事件での保釈は事実上無意味になってしまいます。ただ、この場合でもＡ事件での保釈金が当然に没収されるわけではありません。保釈金は没収されない限り、Ａ事件での判決言い渡し後に戻ってきます。
ふむふむ・・・。つまりカルロス・ゴーン容疑者の件に合わせて考えると、これまでの3回の逮捕容疑の取り調べについて、10億円の保釈金を払って保釈された、ということですが、今回の4件目の逮捕容疑は別の容疑なので逮捕・勾留はされる、と。
ただ前の3件の逮捕の保釈要件を違反したわけではないので10億円の没収はない、と。
（逆にいえば保釈要件を違反すると没収される、ということですね）
で、4件目の勾留が長引くならまた別途保釈金が必要かも、ということで、10億円自体は前の3件の公判が結審した時に返還される、ということですね。
・・・てかめちゃくちゃ先じゃない？
多分この事件はゴーン容疑者側も徹底抗戦っぽいし、立件した検察側もメンツがあるので引けない戦い。なので最高裁までいったりで長くかかると思います。
その間・・・10億円は保全はされるものの、判決が出るまで無利子で預けた状態、ということですね・・・。
保釈金の金額はどうやって決まる？
そもそもの保釈金の金額の決定方法ですが、こちらに超わかりやすく書いてありました。
保釈金の金額は、被告人が逃亡しないように、被告人が「取られたら困る」と思う程度の金額を、裁判所がその人その人に合わせて決めます。
被告人が支払える金額で、しかも「返してもらえないと困るから、裁判所が指定した条件はきちんと守ろう」と被告人が思うような金額でなくてはなりません。
つまり被告・容疑者の経済状態によって増減するわけで、カルロス・ゴーン容疑者の場合は10億円だった、ということですね。そんな再逮捕のニュースが駆け巡るなか、別の保釈金のニュースもありました。
コカインで逮捕されたピエール瀧容疑者ですが、こちらは保釈金400万円とのこと。容疑等々もありますが、カルロス・ゴーン容疑者との差、2,500倍。
それくらい経済条件が違う、ということなんですねー。
