退職代行サービスって？ブラック企業あるあるあれこれ。
ブラック企業という言葉もすごく一般的になりましたが、過重労働もそうですが辞めるときも大変だったりするそうで。
最近よくみかける「退職代行」のサービス。これの利用を禁止する規定を作ろう、という発想・・・は危ないですね。
職業選択の自由、就職や退職の自由は憲法に保障されている権利なので会社規定作った所で意味ないんですが・・・。
別途こちらのTogetterのスレを見ていても、ブラック企業あるあるの話は山程出てきます。
とある労働事件の審判で社長が『あ、うちは有休やってないので』とキッパリ「労働法を学ばないと経営者になれないような仕組みってできない？」
弁護士って大変だ

うちは労働基準法に加入していません
これもひどいですｗ 労働基準法非加入。
社会保険かなにかと勘違いしてるんですかね・・・？それでもブラックなんですが・・。

退職は半年前に申告
いや、なんのキャンセル待ちなんですか・・・？
ちょいちょい見ると思いますが民法627条の1に「当事者が雇用の期間を定めなかったときは、各当事者は、いつでも解約の申入れをすることができる。この場合において、雇用は、解約の申入れの日から二週間を経過することによって終了する。」とありまして、2週間で終了です。

ただこのツイートでもそうなんですが、「でも半年前っておかしいんじゃ・・・」という受け取り側の問題もあるのかなぁ、と思ったりします。
そういうもんだ、って言われちゃうと言い返しづらいとか・・。退職でも同じような話で結局納得させられて戻ってくる羽目になったり・・・。
会社と話したくない、話して丸め込まれたくない、という人向けには退職代行サービスを使うのも手です。
2万から3万くらいで退職手続きを代行してくれるサービスとのこと。
最近出てきたサービスなので使われた対象の会社の反応もそれぞれみたいですが・・・。
